WONDERISS HOMES DESIGNS LIMITED TERMS AND CONDITIONS

 

 1. General

  • These terms and conditions apply to all orders and agreements for the sale of furniture and related services provided by [Wonderiss Homes Designs Limited] ("the Workshop") in Kenya. By placing an order with the Workshop, the customer agrees to be bound by these terms and conditions.

2. Orders and Acceptance

  • All orders are subject to acceptance by the Workshop. The Workshop reserves the right to refuse any order at its discretion. An order is deemed accepted when the Workshop issues a written confirmation or commences work on the order, whichever occurs first. Orders can be placed through our physical store, or email.

3. Pricing and Payment

  • Prices are as listed in the Workshop’s current price list or as otherwise agreed upon in writing. The prices of items are always exclusive of any taxes.

  • Payment terms are 70% deposit upon order confirmation, and the balance of 30% within 7 days from the date of confirmation of the order. Payments can be made via M-Pesa, bank transfer or any other mode of payment agreed upon in writing. All payments are non-refundable unless otherwise stated in these terms or otherwise in writing.

  • Failure to pay the balance within the 7 days will attract a penalty of five percent for each day that the balance remains outstanding. However, if the balance and the penalties accrued remain unpaid for 14 days the Workshop may resell the furniture and the Customer shall forfeit the Deposit.

4. Delivery /Installation/Collection

  • Delivery dates are estimates and are not guaranteed. The Workshop is not liable for any delays in delivery caused by unforeseen circumstances.

  • If Customer opt for delivery, the Customer is responsible for providing accurate delivery information and ensuring that the delivery site is accessible and ready for installation.

  • The Workshop offers installation services at an additional cost. If the Customer declines this service, the Workshop is not liable for any damage or issues arising from self-installation.

  • Delivery charges apply based on distance.

  • If Customer opts for collection, the furniture should be collected within 14 days after notification that the furniture is ready for collection. If the furniture is not collected within the timeline, the Workshop reserves the right to retain the furniture and any payments made by the customer as liquidated damages or dispose the furniture as it sees fit, including reselling it, to cover the costs of storage and any losses incurred.

5. Warranty and Returns

  • The Workshop warrants that all furniture is free from defects in materials and workmanship for a period of one year from the date of delivery, and that the furniture are free from any charge or encumbrance in favour of any third party.

  • This warranty does not cover normal wear and tear, misuse, or damage caused by improper care, defects resulting from any modifications by the customer or third parties or use of the furniture in a manner other than that for which it was designed, defects caused by extreme conditions including but not limited to moisture, temperature, or sunlight.

  • The Customer must inspect the furniture upon delivery and report any defects within seven days. The claims must be submitted in writing to the Workshop accompanied by proof of purchase and photographs of the defects. Failure to do so will be deemed acceptance of the furniture and waiver of any claims related to defects or damages apparent at the time of delivery.

  • Returns are accepted only for defective products and must be authorized by the Workshop. Unauthorized returns will not be accepted.

  • Customized items cannot be returned unless they are defective.

  • Under no circumstances shall the Workshop be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of use, loss of profits, whether arising in contract, tort, or otherwise. 

6. Liability

  • The Workshop's liability is limited to defects in materials and workmanship that are identified within one year from the date of purchase/completion of services.

  • If a defect covered by warranty is discovered and notified to the Workshop in compliance with these terms and conditions, the Workshop will review the claim, if deemed valid, will at its discretion either repair the defective furniture, replace it with similar item, or refund the purchase price.

  • The total liability of the Workshop for any claim arising out of or in connection with the manufacture, repair, or sale of the furniture shall not exceed the amount paid by the customer for the item or service that gave rise to the claim.

  • The property and risk in the furniture shall pass to the customer upon notification that the furniture is ready/complete for delivery.

7. Intellectual Property

  • All designs, drawings, and materials created by the Workshop remain the intellectual property of the Workshop and may not be used or reproduced without written permission.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Kenya.

9. Amendments

The Workshop reserves the right to amend these terms and conditions at any time without notice. The current version is available upon request.
